How Many Pages Should Your Notice of Supplemental Authority Be?
Maybe I'm one of those old fart lawyers Brian Tannebaum is always writing about, but I was taught that a notice of supplemental authority should be a one-page document listing the new case, with at most one line or two explaining its relevance.
It shouldn't be an opportunity to engage in another set of briefing that renders the federal rules superfluous.
But we all know lawyers who can't resist using the new case to reargue points already made in the briefs, and who go way overboard -- causing you a moral dilemma: should you respond in kind? Move to strike? Turn the other cheek and ignore the sharp practice? Hope the judge does something sua sponte?
Case in point:
This supplemental authority is fairly restrained, though you could argue it goes a paragraph too far.
But like the old Cold War doctrine of MAD, an overwhelming and devastating response was inevitable.
And here it is -- three full pages of responsive argument.
Not willing to leave well enough alone, here is the "reply" in support of the notice of supplemental authority -- four(!) more pages of pure argument.
Aren't there page limits in briefs for a reason?

Donald Trump To Allow Planes To Fly Over Mansion After All!
When last we checked in on The Donald's efforts to protect Palm Beach residents (him) from annoying airplane noise over Mar-a-Lago, Trump attorney Jim Beasley was proclaiming victory even though most of his claims were dismissed.
Now, through new counsel(?) John B. Marion IV, it appears victory is complete as Trump is dropping the lawsuit entirely:
“Since the reason Mr. Trump filed this lawsuit in the first place was to protect the citizens of Palm Beach County affected by unreasonable airport traffic and noise, and since it is now apparent that the county has abandoned or put the very things that threatened those citizens on indefinite hold for at least 34 years, Mr. Trump has decided to dismiss the case for now.With Trump everything is always win-win, isn't it?
“However,” the letter went on, “he will not hesitate to file a similar action in the future should the county again take action which threatens county residents with unreasonable airport noise and traffic.”

Donald Trump Is Too Busy Talking About Obama's Birth Certificate to Appear at Mediation.
I completely agree with Judge Jordan -- why should Donald Trump have to appear at a mediation when he can send
Question -- does "Mr. Garten" have a true live birth certificate, or just a ginned-up-in-Kenya fancy-dancy chardonnay-stained certificate of live birth?
Or maybe it's as phony as Mr. Trump's own "birth certificate"?
Let's just put it on the table -- just who is this mysterious "Mr. Garten" and why does he have Mr. Trump's "full authority"?
I'm just asking the question!

Jim Beasley Fights to Save Donald Trump From Horrors of Airplane Noise!
It's nice to see Palm Beach litigator Jim Beasley devoting his prodigious talents toward a truly worthwhile cause:
"The Donald" and his exclusive Palm Beach island club may just have to endure sharing airspace with Palm Beach International Airport.
Circuit Court Judge Joseph Marx has dismissed Donald Trump's lawsuit aimed at redirecting flights from the county airport that the real-estate-tycoon-turned-TV-star deemed too disruptive for his Mar-a-lago Club.
Trump's suit, filed in July, targeted the noise from passing airplanes, saying they were affecting Mar-a-lago's property values as well as the ability to use the historic property.
His suit sought to bar flights over Mar-a-lago, stop proposed airport expansion and even accused Airport Director Bruce Pelly of "intentional battery" for refusing to shift flight paths or make other changes to lessen the disruptions.
"It was very far reaching," Assistant County Attorney Andrew McMahon said about Trump's lawsuit. "The issue of whether it is a 'battery' is way out there."
I'm kidding of course -- this is a very nice client for any lawyer to have.
In fact, I'll go Jim one better -- I think the mere presence of an airport anywhere in Palm Beach County constitutes an "intentional battery" on Mr. Trump and I would have the entire airport arrested and dragooned back to Broward, where it belongs.
But Jim says it's not over, over:
Trump's attorney James Beasley said Trump will re-file and keep pushing for changes at the airport.
"The current way that the county has flights out of the airport is creating a nuisance," Beasley said. "If you were ever at Mar-a-lago when an airplane is going over, you can't talk."Wait a minute -- a half-million? That's it?
Trump's suit already has prompted the county to spend about $50,000 on hiring outside attorneys. If the case continues, the county's contract with the outside firm calls for up to $500,000 in additional costs.
I can bill a half million to this file just sending out a 30(b)6 notice -- you guys ought to just move the airport now.

When Is Trump Tower Not Trump Tower?

When The Donald says it's not:
This case again raises the issue, so carefully analyzed by Judge Seitz, of whether consumers can be misled by the overall impression and strength of an expensive condo marketing campaign as against disclaimers and exculpatory language inserted (buried?) some place in the contract docs.Thirty buyers of Trump International units at 551 N. Fort Lauderdale Beach Blvd. are suing the developers and Trump for allegedly misleading them into thinking the TV star's participation was a sure thing. Though sales contracts identify the project as the SB Fort Lauderdale Hotel & Condominium and state that Trump can withdraw from the licensing deal, the suit claims that marketing materials suggested Trump was on board as a developer.
''Everybody thought they were buying into Trump Tower,'' said Joseph Altschul, the Fort Lauderdale lawyer who filed the suit in Broward County Circuit Court.
The suit claims plaintiffs ''paid a premium for a condominium unit with the Trump name purportedly attached to it,'' reads the suit filed in Broward County Circuit Court. The project's website described it Thursday as ``a signature development by Donald J. Trump.''
The short answer: Joe, don't put a lot of money in this one.
When "mere multimillionaire" The Donald pulls out, maybe you should too.
