3d DCA Watch -- Throwback Wednesday?

I think the bunker got a little nostalgic today -- consider these moldy golden oldies unearthed by the RRO* this week:

Marder v. Moscoco:

This case is actually about a charging lien filed by Ruden McClosky!

What's next -- an application for fees by Fine Jacobson?

Miccosukee Tribe v. Lehtinen:

Here you have a two-fer:  the Tribe unsuccessfully seeking to remove Joe Klock as counsel for Dexter Lehtinen.

Query -- did Joe receive an "unfair informational advantage" by representing a poor innocent damaged yacht owner by repping the ex-Tribal attorney in other matters:
In the underlying cause, it cannot be said, and no such allegation has been made, that Klock has obtained an unfair advantage in his representation of respondent in his defense of petitioners’ claims. Whether or not Klock obtains an unfair informational advantage in his representation of clients against respondent in other, unrelated matters is pure speculation at this time. Certainly, if petitioners believe at some point in the future that Klock has indeed obtained such unfair informational advantage in those cases, petitioners are free to seek Klock’s disqualification in the courts in whose jurisdiction the cases lie.
In other words, time will tell (it always does).

*"Resplendently Robed Ones" -- get with the lingo already!

Stay Away, Joe: Klock Inevitably Invokes "Peace Pipe" in Tribal Motion to Disqualify!

How is The Intrepid One™ able to elicit such delicious quotes?

(Maybe you need to interview the right people.)

Continuing her blockbuster reporting on the growing Miccosukees vs. All Their Former Lawyers mess, Julie managed to ask Joe about a motion to disqualify his law firm RKRPEVN, (aka the spy agency from Get Smart?) which is representing longtime former tribe attorney Dexter Lehtinen.

The motion was filed by current tribe attorney Bernie Roman:
"The idea that I represent other people that are adverse to the Indians so I can't represent Dexter is ludicrous," Klock said. He said adding that Roman, the tribe's Miami attorney, "has been smoking something. He must be passing around the peace pipe. It's hard to take this motion seriously."
I'm glad Joe stopped there.

In fact, it's taking every fiber in my being to not run with this and throw in every impermissible historic pop cultural Indian reference and/or caricature lurking in my subconscious and just set off on a wildly inappropriate yet epic riff.

But it's a holiday so I'll just note that I'm with Joe on the merits here -- the motion makes no sense, Ke-mo sa.... shoot!

The motion makes no sense.

3d DCA Watch -- Dumb Cases Make Dumb Law.

As we prepare ourselves for a post-Ramirez 3d DCA, let's take a look at what the bunker dwellers have been doing with The Big Man still on board:

Leibell v. Miami-Dade County:

Here we have Judge Shepherd and a class action.

Now before you jump to any conclusions, let me just say this sounds to me like a really dumb case so I can understand why the trial and appellate courts ruled the way they did.

Next stop for plaintiff:  OCCUPY VENETIAN ISLANDS!

Crestview II v. TotalBank:

Have you heard this one -- Harry Payton, Tew Cardenas, and Dexter Lehtinen walk into a bar......

Alvin Gentry v. Morgan:

This is a child support modification case, in which Judge Ramirez observes:
While there may be moral deficiencies in Gentry’s refusal to facilitate his child’s academic achievement, we cannot say these deficiencies require overriding an agreement that is legally valid.
 So true.

That's where the whole Hebrew National "higher authority" thing comes in.

SFL Friday -- Go Go Aqua Girl!

Well it's a bit of slow day around here, legal news wise.

If you're interested, the Florida Supreme Court ruled yesterday that they're pretty much the only ones who can determine what constitutes the unauthorized practice of law.

Then I see that Dexter Lehtinen will no longer be handling at least some major Miccosukee Tribe stuff, which will now be solely the responsibility of Sonia O'Donnell, a quality lawyer who works at my friend Frank Burt's shop.

Those who are SFL-bi-curious can find me here next week.

What else?

Actually, who cares?

I'm off to sail the seas, to sow the seeds, to put an end to need, and the politics of greed....

Before I go, be careful where you Facebook, interesting new uses for egg timers, and ummm go go aqua girl?

Have a great weekend!
